According to Thomas Reid, an agent cannot be free unless she has the power to do otherwise. This claim is usually interpreted as a version of the Principle of Alternate Possibilities. Against this interpretation, I argue that Reid is committed to the seemingly paradoxical position that an agent may have the power to do otherwise despite the fact that it is impossible that she do otherwise. Reid's claim about the power to do otherwise does not, therefore, entail (...) the Principle of Alternate Possibilities. When it is an agent's character that deprives her of alternate possibilities, she is not thereby deprived of either power or freedom, and this is true even if the agent was not free or active in the formation of her character. Contemporary discussions of the epistemology of testimony are often framed in terms of the disagreement on this topic between Hume and Reid. However, it is widely assumed that, prior to Hume, philosophers in the grip of Enlightenment individualism neglected philosophical questions about testimony, simply treating testimony as ordinary empirical evidence. In fact, although the evidential model of testimony was popular in early modern philosophy, it was also the subject of vigorous debate. Clegg Varied answers to a fixed question have often guided interpretations of Conrad's novella, Heart ofDarkness. Who, that question has been, was Conrad's model for the enigmatic colonial official he calls Kurtz? Hannah Arendt has speculated that it was Carl Peters, an early explorer of east Africa.1 Norman Sherry has picked Arthur Hodister, a Belgian officer, as his candidate.2 Ian Watt has (...) likewise suggested historical figures: Henry M. Stanley and King Leopold of Belgium.3 Since all these men had a reputation for cruelty, those thinking that Conrad had them in mind when describing Kurtz have stressed the political message of his story; for them it is basically an indictment of colonialism. Stephen Reid has argued for a mythic model. Kurtz, he holds, was meant to be seen as one of the man-gods of Frazer's Golden Bough—a primitive king who is obliged to maintain his political position by engaging in certain bestial rites.4 Kenneth Bruffee has recendy cast Kurtz as Conrad's version of Byron's Childe Harold, arguing that the eventualjudgment on him by the character Marlow represents the effort of a squire-narrator to free himself from the pernicious influence of his knight-hero.5 For Bruffee Heart of Darkness is the prototype of a genre oftwentieth-century literature thatrejects the values ofaristocratic romance in favor of democratic norms. There may be truth in all these associations of Kurtz with known colonizers, mythical kings, and fictional knights, but they share a pair of deficiencies. They do not clarify the argument of Heart ofDarkness and so do not dojustice to its copious philosophical content. They also 280 Jerrys. Clegg281 fail to note those features ofKurtz that identify his model most precisely. The prototype of Conrad's famous character is biblical. He is a modern version of Abraham, and the work most intimately related to Heart of Darkness is Kierkegaard's panegyric on Abraham: Fear and Trembling. Conrad's story is, in fact, an addendum to Fear and Trembling written from the point of view of a poet-narrator—Marlow—who has accepted some, but not all, of the tenets of Kierkegaard's own poet-narrator, Johannes de Silentio. It is Marlow's quarrel with de Silentio that explains the structure of Heart ofDarkness, that constitutes its deepest message, and that tells the reader who the model for Kurtz was. An appreciation of that quarrel also helps clarify other matters. It makes plain, for example, the symbolism of light and dark that Conrad uses as an accompaniment to his argument.6 Heart of Darkness is, unarguably, a meditation on several subjects. It is about the Belgian Congo under the administration of King Leopold. It is also about European colonialism in general. It may be about other matters as well. Its primary subject, however, is the relationship of the religious to the ethical and the aesthetic. Since for Conrad the ethical and the aesthetic were allied, this subject may be best cast as the relationship ofreligion to art. It is introduced at the very start ofthe novella. Conrad's primary narrator there offers a theme for his seafaring friend, Marlow, to meditate on aloud: the great English knights-errant of the sea who, like "jewels flashing in the night of time," have born the torch of civilization into the mystery of an unknown earth.7 As this theme is announced, what was a mournful gloom that had hung over London becomes a lurid glare under the stars, and Marlow begins to talk of these, and still other, kinds of light and their relationship to the dark. The primary narrator has already identified what the dark stands for: time. Marlow does not challenge that equation. He only asks who, and with the aid of what kind of light, effectively combats "the night of time." During his meditation he considers four answers to his question, three of which are of primary importance. Psychotherapy holds out the promise of help for people who are hurting and in need. It can save lives and change lives. In therapy, clients can find their strengths and sense of hope. They can change course toward a more meaningful and healthy life. They can confront loss, tragedy, hopelessness, and the end of life in ways that do not leave them numb or paralyzed. This essay selectively reviews, from an historical and philosophical perspective, the dopamine (DA) hypothesis of schizophrenia (DHS; Table 1 lists the abbreviations used in this essay). Our goal is not to adjudicate the validity of the theory—although we arrive at a generally skeptical conclusion—but to focus on the process whereby the DHS has evolved over time and been evaluated. Since its inception, the DHS has been the most prominent etiologic theory in psychiatry and is still referred to widely in current (...) textbooks (e.g., Buchanan and Carpenter, Jr. 2005, 1336; Cohen 2003, 225; Gazzaniga 2004, 1257;Kandel et al. 2000, 1200). A national survey sent to 450 female and 450 male licensed psychologists (return rate = 42%) found that about 73% of the participants reported encountering at least one patient who claimed to recover previously forgotten memories of childhood sex abuse. About 21% of the therapists concluded that, for at least one patient, the memory was false; about 50% of the therapists reported that at least one patient had found external validation for the abuse; about 12% of the therapists reported at (...) least one client who later decided that the memory was false; and about 15% of the therapists reported that at least one client who recovered memories filed a civil or criminal complaint. About 15% of the therapists reported encountering at least one patient alleged to have sexually abused a child who later recovered previously forgotten memories of the abuse. About 21% of these therapists concluded that, in at least one case, the memory was false; about 6% of the therapists concluded that, in at least one case, there appeared to be external validation for the memories; about 1% reported that, in at least one case, the person recovering the memories concluded that the memories had been false; and about 6% of these therapists reported at least one case in which a civil or criminal complaint had been filed against their client. This chapter develops and defends an account of reason: to reason is to scrutinize one’s attitudes by consulting the perspectives of other persons. The principal attraction of this account is its ability to vindicate the unique of authority of reason. The chapter argues that this conception entails that reasoning is a robustly social endeavor—that it is, in the first instance, something we do with other people. It is further argued that such social endeavors presuppose mutual respect on the part of (...) those participating in them. The account therefore yields a form of Kantian constructivism: we have an unconditional duty of respect for persons because such a duty is implicit in the very nature of reasoning. -/- . (shrink)

The book attempts to develop an account of simplicity in terms of testability, and to use this account to provide an adequate characterization of induction, one immune to the class of problems suggested by Nelson Goodman. It is then shown that the past success of induction, thus characterized, constitutes evidence for its future success. A qualitative measure of confirmation is developed, and this measure - along with the considerations of simplicity - is used to provide an account of the consilience (...) of inductions, and also an inductivist account of the structure and progress of scientific theory. An appendix extends the treatment of simplicity to statistical distributions and provides a reasonable interpretation of the maximum entropy principle. Thus, this book is an attempt to characterize induction in terms of a well-defined notion of simplicity and to use that characterization as a basis of an account of empirical, and in particular, scientific reasoning. R. A. Duff has revived the tradition of “answerability” for crime. In this philosophical and jurisprudential tradition, a person is answerable to the criminal law of a state and the process of that state’s courts only if there is some appropriate relationship between the state and the person. Duff’s great contribution has been to develop the idea of accountability of persons to a state or other polity as a philosophical notion which, he argues, underlies all just implementations of criminal law. (...) Duff has centered his views around the relationship between the citizen and the polity (in today’s world, the state) to which the citizen belongs. His focus has been on insiders, rather than outsiders.This article argues that, in the current world, the relationship among cocitizens, outsiders, and the state is based in part on the moral idea that the state exists to protect citizens from evil acts, specifically those that we call public and criminal wrongs, wherever the acts originate. Outsiders understand this, and understand that states other than their own use criminal law to protect their citizens.Duff’s writings contain an idea which turns out to be very useful in cases of outside acts, even though he does not apply it directly to them. Some states or other entities may have only an incomplete relationship with an accused person (compared with the relationship of citizen and state), but nonetheless may have the moral and political authority to try her for crime. This paper extends this notion to show that such incomplete relationships exist in a great many common cases of outsiders (noncitizens who act outside the territory of a state) who commit crime. These relationships support criminal prosecution of outsiders, so long as we admit that protection of persons from crime is a legitimate goal of the criminal law. (shrink)

A dual relationship in psychotherapy occurs when the therapist engages in another, significantly different relationship with the patient. The two relationships may be concurrent or sequential. For both sexual and nonsexual dual relationships, men are typically the perpetrators and women are typically the victims. This article presents examples of dual relationships, notes the attention that licensing boards and other agencies devote to this topic, reviews the meager research concerning nonsexual dual relationships, and discusses common strategies that promote both sexual and (...) nonsexual dual relationships. We compare astronomers' removal of Pluto from the listing of planets and psychiatrists' removal of homosexuality from the listing of mental disorders. Although the political maneuverings that emerged in both controversies are less than scientifically ideal, we argue that competition for "scientific authority" among competing groups is a normal part of scientific progress. In both cases, a complicated relationship between abstract constructs and evidence made the classification problem thorny.

Psychiatry has long struggled with the nature of its diagnoses. This book brings together established experts in the wide range of disciplines that have an interest in psychiatric nosology. The contributors include philosophers, psychologists, psychiatrists, historians and representatives of the efforts of DSM-III, DSM-IV and DSM-V.

The general consensus is that reform of medical malpractice law should be part of the health care system's overhaul. Medical malpractice litigation results in the expenditure of tens of billions annually, largely paid out of health care insurance funds and mostly paid to defendants' and plaintiffs' lawyers. By all accounts, this tort law regime ill serves the basic deterrence and compensation goals of civil liability. The causes and magnitude of these failings are disputed, and many typical reform proposals sidestep the (...) basic problems and may do more harm than good. In contrast, we advance a straightforward way to improve both deterrence and compensation. Essentially, the proposal is to remove current legal limitations on the scope of insurance subrogation that bar private and public health care insurers from “buying” the whole of their insureds' potential medical malpractice claims in exchange for lower premiums and taxes and expanded insurance coverage. Our proposal’s benefits accrue regardless of the cause and magnitude of the failings of malpractice law or the further reforms that might be adopted. (shrink)

This essay discusses unlimited insurance subrogation (UIS) as a means of improving the deterrence and compensation results of medical malpractice law. Under UIS, health care insureds could assign their entire potential medical malpractice claims to their first-party commercial and government insurers. UIS should improve deterrence by establishing first-party insurers as plaintiffs to confront liability insurers on the defense side, leading to more effective prosecution of meritorious claims and reducing meritless and unnecessary litigation. UIS should improve compensation outcomes by converting litigation (...) cost- and risk- laden “tort insurance” into cheaper and enhanced first-party insurance. UIS also promises dynamic benefits through further reforms by contract between the first-party and liability insurers that would take charge of system. No UIS-related costs are apparent that would outweigh these benefits. (shrink)

Il est reconnu aussi que le degré d'organisation varie dans le cours d'une série, des complexités profondes de la cellule aux innombrables modifications exhibées par l'organisme humain. Le concept de la partition effective est basé solidement sur l'évidence présentée par la membrane plasmatique et les limites de phases dans les aggrégations colloidales. De plus il est important de noter spécialement la nature dynamique des équilibres caractéristiques et l'on ne saurait manquer d'attirer l'attention sur la formation continue de partitions effectives aux différents niveaux d'équilibre. L'étude ultérieure de la signification de ces partitions présente un grand nombre d'implications intéressantes. Il est à noter que des difficultés sont rencontrées quand on essaie d'inclure en une description de ce genre les phénomènes mentaux et psychiques. We are gratified at the largely positive comments on our essay on the dopamine hypothesis of schizophrenia (DHS) by these two distinguished commentators from the fields of biological psychiatry (Dr. Tamminga) and the philosophy of psychiatry (Dr. Murphy). There is little that they have said with which we disagree. Rather, we want to expand briefly on their commentaries.We found Dr. Tamminga's reactions to be particularly fascinating because she has been an "insider" to the story of the DHS as it has (...) unfolded. She provides substantial insight into the "extra-scientific" reasons for the persistence of the DHS despite its poor empirical record.She validates our impression that the DHS was in its first years of .. In an era where autonomous technologies are progressively taking over more complex tasks and decision-making previously done by humans, the mastering of paradox-based skills and effectively reconciling paradoxical situations in everyday life will become increasingly important. This paper asserts that understanding and living with paradox is not only necessary for the future of work but also for human flourishing. While work is the primary means by which humans flourish in the traditional sense, there are deeper and more holistic understandings of (...) human flourishing which requires the acceptance and learning of paradoxical realities. Those who are steeped in the understanding and reality of paradox in everyday life can also be more open to these deeper and more holistic understandings of human flourishing. (shrink)

E. T. Jaynes' resolution of Bertrand's paradox in terms of invariance principles is criticized. An experimental setup is considered which generates general solutions to Bertrand's problem by rotating a line around a point a distancer+d from a circle of radiusr. The general solution obtained is neither translationally nor scale invariant, but depends on the value ofr/d. Only in the limitr/d » 0, when the line is just translating across the circle, is the distribution translationally invariant and scale invariant.
